Anti-gun factions are champing at the bit to destroy the American firearms industry. To that end, they like to pretend the industry is immune to lawsuits; that it is able to do as it will while Americans have no recourse in court.
“This is the only outfit that is exempt from being sued,” President Joe Biden said at a ceremony announcing the beginning of his war on the Second Amendment. “If I get one thing on my list — (if) the Lord came down and said, ‘Joe, you get one of these’ — give me that one.
“Most people don’t realize, the only industry in America, billion-dollar industry, that can’t be sued, exempt from being sued, are gun manufacturers.”
That, of course, is wildly untrue and the stuff of dreams for anti-gun forces that hope a tornado of lawsuits could wipe out the industry altogether.
The 2005 Protection of Lawful Commerce in Arms Act says gun manufacturers cannot be held liable for the use of their products in a crime. That seems fair to us. They can, however, be sued for a wide range of things, including negligence, marketing practices, breach of contract regarding the purchase of a gun or certain damages from design defects, CNN reports.
Other industries also have certain exemptions from liability. Vaccine and pharmaceutical manufacturers and airlines, for instance, have special immunity from some types of lawsuits, and the gun industry does not have complete impunity.
Biden and others would change all that with the intent of destroying the industry.
We are left to wonder: Is there anything these folks will not claim, will not do, to disarm Americans?
